Elkhart Booking Reports and Public Records Law

Indiana law makes Elkhart booking reports public. Under IC 5-14-3-5, when a person is arrested in Elkhart, the agency must share the person's name, age, and address. The charges must be public too. So must the time and location of the arrest, plus who made the arrest. These are not optional disclosures. The statute uses "shall," which means the information has to be given out.

When someone enters the Elkhart County jail, the jail must also disclose why the person is being held, when they came in, and their bail amount if set. Under IC 5-14-3-3, anyone can view and copy these records during normal hours. You do not need to explain why you want them. Fees for copies max out at $0.10 per page for black and white under IC 5-14-3-8. The agency must respond within seven days per IC 5-14-3-9.
