Booking Reports and Indiana Public Records Law

Booking reports in Marion County are public records. Indiana law is clear on this point. Under IC 5-14-3-5, when a person is arrested or received in a jail, certain facts must be shared with the public. This includes the person's name, age, and address. It also includes the charges, the time and place of arrest, and the arresting officer and agency.

When someone is booked into the Marion County jail, the law says the jail must share the reason for holding the person, the date and time they came in, and when they left or got transferred. The bail or bond amount must also be available if it has been set. These are not optional. IC 5-14-3-5 uses the word "shall," which means the jail has to give this info out.

Under IC 5-14-3-3, any person can inspect and copy public records during normal business hours. You do not have to say why you want to see the records. The agency cannot deny your request just because you won't state a reason. If you file a formal request, IC 5-14-3-9 says the agency must respond within seven days.

Getting Copies of Marion County Booking Reports

Expungement of Booking Records in Marion County

Some booking reports in Marion County can be expunged under Indiana law. IC 35-38-8 sets the rules for when and how a person can ask to have arrest or conviction records sealed. The wait times depend on the outcome of the case. If the arrest did not lead to a conviction, you may file for expungement after one year. Misdemeanor convictions have a five-year wait. Felonies require eight years to pass before you can ask.
